Terms and Conditions

Foxygen hereby provides a twelve (12) year limited warranty (“Warranty”) on all batteries supplied by the Company. This Warranty evidences Foxygen’s assurance in the quality and durability of its products and is intended to provide the Purchaser with certainty and protection.

This Warranty is subject to the terms, conditions, and limitations set forth herein. The information provided on this page is intended to clarify and simplify the Warranty process in the interest of transparency.

The Purchaser is required to notify Foxygen immediately upon becoming aware of any fault or defect in the battery. Upon such notification, Foxygen will provide remote assistance to conduct preliminary diagnostic tests in order to identify the issue. If the fault cannot be resolved remotely, the Purchaser will be instructed to return the battery to Foxygen for further testing.

In the event that the claim is determined by Foxygen to fall within the scope of this Warranty, all reasonable shipping costs associated with the return of the battery shall be borne by Foxygen.


Registering your warranty


As a condition precedent to the validity of the extended twelve (12) year warranty (“Extended Warranty”), the Purchaser must complete and submit the Warranty Registration Form within twelve (12) months from the date of purchase of the product.


Upon timely completion of the Registration Form, the Purchaser’s standard twelve (12) month warranty shall be automatically extended to a twelve (12) year term, subject to the terms and conditions set forth herein.

Failure to register the product within twelve (12) months of the purchase date shall render the Purchaser ineligible to claim the Extended Warranty, and in such event, only the standard twelve (12) month warranty shall apply.


Warranty Ownership


Upon registration, the twelve (12) year warranty (“Extended Warranty”) shall be deemed to apply exclusively to the original purchaser of the product who has duly completed the registration process (“Registered Owner”).


The Extended Warranty is personal to the Registered Owner and is strictly non-transferable, non-assignable, and non-saleable to any other individual, entity, subsequent purchaser, or transferee of the product.


What is covered under warranty?


The standard twelve (12) month warranty and the twelve (12) year warranty (“Extended Warranty”) covers defects in materials and workmanship arising solely from the manufacturing process. This includes, but is not limited to, faults in the materials utilized or deficiencies in the production of the product that directly result in the failure of the battery, such as:

  • Failure of the Battery Management System (BMS)
  • Failure of the Cells
  • Faulty Temperature Sensors
  • Failure to Charge properly
  • Failure to Discharge properly
  • Corrosion of internal elements


What isn't covered under warranty?


The standard twelve (12) month warranty and the twelve (12) year extended warranty (“Extended Warranty”) expressly exclude coverage for the following:


  • Damage resulting from gross negligence.
  • Normal wear and tear.
  • Damage caused by accident or collision, including but not limited to impacts and drops.
  • Abuse, including but not limited to opening the battery casing, modification, or tampering with the battery.
  • Incorrect installation, including but not limited to loose terminal connections, under-sized cabling, incorrect wiring, short circuits, or reverse polarity connections.
  • Incorrect charging, including the use of unsupported lead-acid–only chargers or charging at voltages or currents exceeding manufacturer-recommended parameters.
  • Environmental damage, including but not limited to inappropriate storage conditions, exposure to extreme heat or cold, fire, freezing, or water ingress.
  • Improper maintenance, including but not limited to undercharging or overcharging the battery.
  • Use in applications for which the battery was not designed, including but not limited to engine starting.
  • Use with an incorrect inverter/charger, including use with an over-sized inverter/charger rated at 3,200 watts or greater without the use of a manufacturer-approved current surge-limiting device.
  • Battery under-sized for specific applications, including but not limited to air conditioners or similar devices with locked rotor start-up currents, unless used in conjunction with a manufacturer-approved surge-limiting device.
  • Incorrect storage, including but not limited to storage at a low state of charge, at full state of charge, at temperatures exceeding 40°C, or on a continual float charge.
  • Updating or tampering with the Battery Management System (BMS) firmware.


All batteries supplied by Foxygen Ltd. have a finite effective life measured in charge cycles. Laboratory testing indicates performance up to 3,000 cycles at 100% depth of discharge (DoD) and up to 6,000 cycles at 80% DoD. Actual performance in real-world conditions may vary and is likely to be lower, particularly where recommended care guidelines are not followed. While Foxygen Ltd. anticipates that the Purchaser will derive many years of use from the product, it is possible that the cycle limit may be reached before expiration of the Warranty period.

Foxygen Ltd. reserves the right to deny any warranty claim if, upon inspection, the product is determined to have reached its normal end of life, even if such determination occurs within the Warranty period.


How do I claim a warranty?


In the event that the Purchaser believes the battery has failed due to a defect covered under this Warranty, the Purchaser must submit a completed Warranty Claim Form through the designated channel provided by Foxygen Ltd.

Upon receipt of the Warranty Claim Form, Foxygen Ltd. will acknowledge the claim and a representative of the Company will contact the Purchaser to request proof of purchase and any additional information necessary to evaluate the claim.


Limitation of Liability


Foxygen Ltd.’s liability under this Warranty is strictly limited to the repair or replacement of the defective battery, at the sole discretion of the Company.


Under no circumstances shall Foxygen Ltd. be liable for any incidental, indirect, or consequential damages, including but not limited to:


a. Loss of use;

b. Damage to property; or

c. Personal injury.


Governing Law


This Warranty shall be governed by, and construed in accordance with, the laws of England and Wales.


Entire Agreement


This Warranty constitutes the entire agreement between Foxygen Ltd. and the Purchaser with respect to the warranty coverage of any Foxygen battery. All prior or contemporaneous communications, representations, or agreements, whether oral or written, are hereby superseded and of no further force or effect.


Severability


If any provision of this Warranty is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from this Warranty. The remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.


Amendments


Foxygen Ltd. reserves the right to amend, modify, or update the terms of this Warranty at any time. Any such amendments shall take effect immediately upon being published and made publicly available on the official Foxygen Ltd. website.
